DISMISSAL
IS
Complainant &as illegally dismissed! Heing a regular employee as de@ned by rticle 89: of the Labor Code, he cannot be dismissed e"cept for 6ust or authorized causes proided for by the Labor Code! De@nitely, he cannot be dismissed on the mere &hims and caprices of the Respondents as aderted to aboe! 5his is so plain to be mista*en! Complainant, in his /inumpaang /alaysay, clearly demonstrated that, prior to his @ling of this instant case, he had been the ictim of discrimination, disdain and insensibility perpetrated by his o&n unit leader, Respondent Eric Folpe! 5he bullying behaiour of his superior did not only harm him psychologically but it li*e&ise inicted, in him, fear for his 6ob security! 5his situation &as in fact e"acerbated by the inde@nite suspension meted on him by Eric Folpe despite the absence of any alid ground that 6usti@es the same!
20
Complainant did not deliberately intend to enses he did not commit! )t is settled that constructie dismissal e"ists &here there is cessation of &or* because +continued employment is rendered impossible, unreasonable or unli*ely, as an o>er inoling a demotion in ran* or a diminution in pay; and other bene@ts! ptly called a dismissal in disguise or an act amounting to dismissal but made to appear as if it &ere not, constructie dismissal may, li*e&ise, e"ist if an act of clear discrimination, insensibility, or disdain by an employer becomes so unbearable on the part of the employee that it could foreclose any choice by him e"cept to forego his continued employment . ssuming, for the sa*e of argument, that Respondents hae grounds to suspend inde@nitely the Complainant, still, Complainant &as denied due process! #e &as 6ust instantly and summarily suspended inde@nitely right then and there! #e &as not een a>orded his right to e"plain and defend his side against any charges hurled against him! )n fact, he &as 6ust plainly been forced to leae his 6ob! 5his is a classic e"ample of an e"ceedingly brutal denial of due process! 5he facts are so &eighty to be oerloo*ed! s can be clearly deduced from Complainant?s Sin#mpaang Salaysay , Respondents did not een properly charge him for any iolation of a particular company rule or regulation! Respondents did not conduct a single hearing so that the Complainant could defend himself or air his side on the charges the former are imputing against him!
