FOREWORD The recent receipt of many letters from students of various se cret schools of the divine sciences, evidencing a deep interest in the occult, the mystic and the higher aspect of the L A W , is, indeed, most gratifying. These letter s show, show, unmistakably, an awakeni ng among those interested in things spiritual. spiritual. The y indicate indicate a wholesome dispositi disposition on toward independent investigation— investigation— to T R Y — to te st all things—to take nothing nothing for granted and to know the truth. If all those who are inter ested in the occult occult and mystic— if all sincere seekers for truth and those endeavoring to find the schools, orders, organizations and societies that point the W A Y , that deal only with pu re whi te magic and guide their students or neophytes upward along the p a t h — wo ul d onl y in ve st ig at e— si nc er el y an d in te ll i gently investigate— the unprete ntious claims of the true and con trast them with the bold, seductive and fabulous claims of false teachers and spurious organi zati ons— if they would would only learn the simple basic distinctions between them-—then, indeed, will the death knell have been finally sounded for those false teachers and master s who havehave- beguiled and misled so many sincere but un informed seekers of the ancient wisdom. Among the letters received, a large number are from sincere seekers of the truth who have been or who are now members of A. M. O. R. C., raising questions bearing directly on the subject mat ter covered by this and othe r companion booklets. Ther efo re, we deem this a fitting time and opportunity to answer the questionsso raised. For the sake of brevity, these questions may be covered under two general headings: 1. Wh y shoul d th ere be so much cont rove rsy as to who wT wTas first or last in the realm of spiritual science and truth for which the Rose Cross stands? 2. Are not all under the L A W and do we not all use the same lawr? lawr? Ther efor e, does it it mat ter so much who teaches the law? Yes, indeed, it does matter who teaches the law and hozv it is

taught. The re are two two opposite aspects of the law. The law may may be us ed f or go od or fo r evil , an d in th e use an d intended use of the law is is the distinction between between white and black magi c— between real schools of higher spiritual training and spurious organizations using and teaching the lower aspects of the same law. The question is not who was the first to teach the spiritual sci ences— ences— there are no first first and no last in in the Kingdom of Truth. The real question is: Which teachers and which schools actually teach the spiritual sciences and guide their students or neophytes along the upward pa th a n d n a r r o w way t o w a r d t h e H i g h e r K i n g d o m o f Truth, in accordance with the highest and noblest aspects of the law, and which leaders and which organizations actually teach the bla ck a r t a nd gu id e th ei r fo l lo we rs or me mb pr s a lo ng t he d ow n ward path and broad way to perdition and destruction, in accord ance with the lowest and most ignoble aspects of the same law? In short, the real question is: Which are true schools of pure white magic leading the way to life, and which are spurious, posing as spiritual schools, but nevertheless teaching and practicing the foul bla ck ar ts l ea di ng th e wa y to de s t ru c t i on ? Truly, this is a serious and fundamental question of profound interest to all masters, teachers and leaders, as well as all follow ers, students and neophytes of all schools, orders and societies of the Gre at Whi te Bro ther hood. It is a call to all of these to band and stand and fight together in a common cause for the protection and in the interest of all uninformed yet sincere seekers of the upward pa th and the narrow way to light — le st th ey be al lu re d, be gui le d an d le d a s tr a y an d di r ec t ed in t he do wm wa rd pa t h an d taught the lower aspects of the law by pseudo-masters and design ing teachers who seek them for mercenary reasons or for other viie purposes as members of their dangerous and spurious or ganizations. We need not figh fightt for our own own organizati ons. Being true, they are secure against all the furies of hell and all powers of the black magicians, but when we do fight in the name of and for the rights of our own true school, order or society against spurious and clan destine organizations, using its name and purporting to give its teachings, we fight truly in the interests of and for the protection of all sincere seekers of the upward pa th and narrow' way that leadeth to the light and the wisdom. So must every school, order and society working under the sanc tion of and in accordance with the teachings of the Great White

So, So, also, must all all fight for the rights and protection for all other organizations un der the guidance of the Elder Brothers of the Great White Brother hood, to the end that no true seeker for the light may be misled however uninformed and gullible or susceptible to alluring pleas, siren calls and beguiling solicitations of pseudo-masters and fabri cators of spurious organizations. Let no one misconstrue our statements or place the Rose Cross in a false light. We have no quarr el with those who teach divine science and the right aspect of the law, and it matters not in what manner they teach or the method or training used, so long as they po in t th e wa y to li fe. T h e y ar e o f th e W h i t e B ro th er ho o d an d ar e entitled to our support and encouragement; verily, they have it without reservations or limitations. Fundamentally we are not concerned as to who or which or ganizat ions were first first in the .field .field of Rosicrucianism, but we a re greatly and essentially concerned in knowing that they are truly Rosicrucian and came by way of the Rosy Cross. If those who claim to propound the philosophy of the Order were qualified and those who pretend to guide the neophytes into and through the mysteries of the Rose Cross, and to teach its esoteric lessons, wer^ really capable of doing what they profess to do, then we would have no quarrel with them. Our quarrel is with those who claim to be Rosicrucians when they are not; who claim to expound the philosophy of the Fraternity wdien they do not understand or comprehend it; who pretend to guide and carry neophytes through Rosicrucian training to mas tership who have never been enrolled as neophytes and are not initiates; who know nothing of the sublime esoteric teachings of the Order and who have no right or authority to teach or guide others because they have not come by way of the Rosy Cross. I t is against this this that we protest— vigorously protest: It is also against the improper use of the name of the Fraternity and the deceptive use of Rosicrucian appellations that we fight, because the august Fraterni ty is thus brought into disrepute disrepute and discredited, discredited, and thousands of honest seekers for the authentic Temple of the Rosy Cross have been and will be deceived, betrayed and led astray. It s ph il os op hy ha s s t oo d t he te st of ages; it has been weighed in the balance of time and found not wanting; it deals only with pure white magic and is a part of and is under the protection and guidance of the Hierarchies of the great White Brotherh ood. Its neophytes enter under the most solemn solemn obligation to which the soul can subscribe, which prescribes the pr in ci pl es an d in cu lc at es th e do ct ri ne t h a t on ly he, wh o th ro ug h obedience to instructions, who has actually lived the life, who has traveled the whole path and who has thereby gained the goal of Illumination or Initiation is worthy of leadership and is capable of teaching or leading others. When its neophytes have become initiates, they know the law and understand exoteric manifestations as well as its inner work ings ings.. Ther efor e, none of its initiates initiates have ever violated or cast aside their obligations and established or attempted to establish a schism, a separate activity or a clandestine’ body of the Grand Fraternity. Therefore, clandestine Rosicrucian Temples and spurious Rose Cross Orders have never been established by Rosicrucians who pos se ss t he kn ow l ed ge t o te ac h re al Ro si cr uc ia n p hi lo s op hy an d esotericism, but by simon pure impostors who cannot and who do not teach Rosicrucian phi losophy or poi nt the wr wray to Rosicrucian illumination or initiation, who willfully deceive and grossly mis lead their adherents both as to what they are and as to what they teach. It is against this dang erou s practice and its its far-r eachi ng evil evil consequences that wr wre protes t. The se pret ender s and impo stor s must be be exposed. Ther efo re, it is our duty to continue the fight fight until they are banished and are made incapable of deceiving and misleading seekers on the way to the door into the T e m p l e o f t h e Rosy Cross.
These same questioners ask, in substance: Will not truth itself adjust the mat ter ? Will not not the right organizatio n prevail prevail and the pretenders be eliminated by the law? Undoubtedly, in time and ultimately all that is evil will be de stroyed by the reaction of the law. Thi s w'e w'e know because it it is th e law. law. But if man, being a free agent, were to depend entirely upon the law and failed to make the effort to F R E E H I M S E L F from evil, then, to be logical, we should eliminate all human agencies which have have for their purpose the welfare and protection of mankind — of man, man, woman and child. child. INTRODUCTORY T h e work of Rosicruciae in all its phases, whether it be the Or der, I emple, emple, Bro therhood or Fra ternity, is more concerned with the spiritual kingdom and its laws as they affect man than with mundane and temporal affairs, though it has in mind and as its object the betterment and advancement of man in every depart ment of his his nature— physic physical, al, mental and spiritual— more espe cially the soul. I his being so, so, its work has alwa ys been secret, havi ng in mind mind the several admonitions of the great Master: “Let not thy left hand know what thy right doeth,” and again: “When ye pray enter into thy secret closet and close the door, etc.,” comprehend ing that it is not to the best interest of man or the work itself that good works and spiritual services should be advertised, to be seen or praised of men, and that the services themselves will bring their own reward.* For three hundred years this “ancient landmark” of the Grand Fraternity has been adhered to, and it has been rare and seldom that a living man was known as a Rosicrucian or as having any connection connection with the Order. The n there came a change. We enter ed the ultra-business age, age, the age of exploitation; an age in which there is nothing too sacred to be exploited, whether it be the virtue of woman, the bodies of men or even the Kingdom of Heaven, so long as any of these could be made to yield a profit in the current coin of the realm. It was, was, therefore , pounced upon by pseud o occultists and charlatans as a fertile field for profit, and within a few years we have seen the organization of numerous activities calling themselves by various Rosicrucian appellations, all of them self-organized, without legitimate authority, and all catering to the most selfish instincts in man, instead of to the deepest and most spiritual spiritual emotions of the soul— the true spirit of the authentic Fraternity. During the last few years promoters of various types have or ganized spurious bodies representing them to be genuine bodies of highly reputed, established Societies, Orders, Brotherhoods, Fra ternities and Associations, plagiarizing and using their names, or names so similar, as to give them the appearance of being genuine. Therefore, to protect the public against such deception and fraud, the legislatures legislatures of many of the states have passed laws for the reg istration of names, titles and appellations of genuine and authentic bod ie s. T h e Co m mo n w ea lt h of Pe nn sy lv an ia ha s suc h a st at ut e for the preservation of the rights of authentic bodies and the pro tection of the public against such frauds. In the momentous year of 1773 the first great Council of the Brotherhood of the Rosy Cross in the new world was convened in the City City of Broth erly Love. It is is not our purpose to deal with this meeting of the Council or its history or activities, which have bee n gi ve n co ns id er at io n in a n ot h er of ou r pu bl ic at io ns .* T h e fa ct is here noted only to show the existence and continuation of the Council of the authentic Order in America since said time. While the Council has been in continuous existence since said time, the first Supreme Grand Lodge, Temple or Order of the Brotherhood or Frat ernit y was not established established and did not function function as such until about the year 1856-58,1 when it was established by Dr. P. B. Randolph after he had returned from Germany and France, where he received his final initiation and had been ordained S u p rree m e G r a n d M a s t e r o f t h e S u p r em em e M o t h e r L o d g e . The first American Supreme Grand Body continued to function under Dr. P. B. Randolph until he was regularly succeeded by Freeman B. Dowd as the second Grand Master in the year 1875. aid of the Supreme Council, established a Supreme Grand Temple of the Rosy Cross in Philadelphia, Pennsylvania, where the Su pr e me Cou nci l o f th e O r d e r fi rst fu nc ti on ed an d in whi ch s ta te th e Supreme Grand Lodge and Council have continued to function since the year 1882. The Supreme Grand Lodge of all Rosicrucian bodies in America and the isles of the sea is still located in the State of Pennsylvania. It is the direct and lineal descendant of the first supreme grand bo dy es ta bl is he d in 18 56 -5 8 an d is th e s up re me au t h or i t y o f th e authentic and legitimate Order in America. N o t w i t hs t a n di n g t h a t th e au th en ti c Or de r, T em p le , B r o t h e r hood and Fraternity of the Rose Cross has been continuously func tioning in America through its Grand Councils or Lodges or both since the year 1773,* and its various names, -titles and designa tions have been long and firmly established and pre-empted by p ri or use, yet , ne ve rt he le ss , be gi nn in g less th an a qu ar t e r o f a ce n tury ago, and since then, spurious and clandestine Rosicrucian bod ies, self-organized and without authority, have appeared, using various Rosicruc Rosicrucian ian terminology and appellations appellations.. One in pa r ticular, the Ancient and Mystical Order Rosae Crucis (A. M. O. R. This organization, an adjunct adjunct to the the Grand Fratern ity, was incorporated in Delaware in 1909 and its charter amended in 1928, to better carry out its original purpose and object. object. It was or ganized for the express purpose of holding title to the property of the Fraternity, the transaction of its business in the various states of the Union, also in foreign countries, and the protection of its various names, names, titles and appellations. Th e applications for regis tration of names and titles, so vigorously protested by Mr. Lewis, were originally filed by the Royal Fraternity Association in behalf of the various Orders, Brotherhoods or Degrees of the Fraternity. For legal as well as practical reasons, those applications were with drawn and refiled by the various Orders, Brotherhoods or Degrees of the Fraternity directly directly in in their own behalf. This explanation will account for the reference to the Royal Fraternity Association, which was not, in fact, involved in the proceedings for the regis tration of names. The Royal Fraternity Association was registered in Pennsyl vania in 1916 and so continued until the new corporation law' re quired re-regi strati on of all all foreign corpor ation s in 1934. Appl i cation wras made for the re- registra tion of said forei gn corpora tion , which was promptly protested by Mr. Lewis through his attorneys and members of his organization. Th e application application for re-registra tion was not pressed, but was finally' finally' abando ned, n ot because of Mr . Lewis’ protest,' but because because our legal couns counsel el advised us that since the Beverly Hall Corporation,- a domestic corporation of the first first class, class, had been f unctioning for, a number of year s in Pennsyl vania and possessed all the corporate powers of the Royal Frater nity Association, there wras no practical reason or legal necessity to re-register said corporation in the Commonwealth of Pennsyl vania. However, assuming for the purpose of argument and clarity of statement— but not as a matt er of fact— that an authentic Rosi crucian Grand Body or Grand Master had issued to Mr. Lewis a genuine warrant of authority to institute and establish the Order in America in 1915, he could not have legally done so or exercised such authority, because at that time an authentic Supreme Grand Lodge of the Rosicrucian Brotherhood, Order and Fraternity, hav ing exclusive jurisdiction over all of North America, was in exist ence and had been active for almost sixty years prior thereto, using all all Rosicrucian names and titles. By his const ant univer sal advertising for members, by the use of all the alluring, craftily worded and cleverly constructed display advertising known to the modern art of high-pressure salesmanship, he has run counter to the most basic precept and ancient landmark of the Grand Frater nity, and in so doing he has clearly demonstrated to all who are informed— even even unto those who have made the slightest investiga investiga tion, that he is not a Rosicrucian; that he cares nothing about the noble principles, the sublime philosophy, the great work, the holy mission of the august Fraternity and, furthermore, that his fabri cated spurious A. aware in 1915, prior thereto and since, that f&r sixty years there has has been a regu lar Rosicrucian Ord er in this country, is true. It' can be established beyond the peradventure of a doubt and to the complete satisfaction of any fair-minded, unprejudiced student seeking the truth. The reference is made to the authentic Order, which has had a Supreme Grand Council since 177.3 and a Grand Temple or Lodge in Pennsylvania since 1882, and where the Supreme Grand Lodge or Se e has been maintained for a number of years, and to th e Philosophical Publishing Company, which has published several boo ks de a li ng wi t h th e Ro si cr uc ia n O r d e r an d its ph i lo so ph y. Mr. Lewis was not forced to recognize the sale of real or socalle called d Rosicrucian Rosicrucian books books as as constitut ing aan n Ord er. T ha t would be pr ep os te ro us . It wa s pr e po s te ro u s su bt er fu ge on hi s p a r t to cloud the issue, an artifice to hide the truth and a clever stratagem to create a doubt in justification of his wrongful and unholy acts. The sublime and August Fraternity is not so constituted ami, as we have so often stated, lias nothing to do with the sale of books, Rosi crucian or otherwise. The plain fact and whole truth is that he was forced to recog nize the existence of the regular and authentic Order of the Rosv Cross, which has been in continuous, active existence since it was instituted in America about the year 1856-58, with Dr. P. B. Ran dolph as its first Supreme Grand Master, a high initiate and real Rosicrucia Rosicrucian. n. Th at was his first difficulty difficulty;; was wha t all all the a rgu ment was about; that was the reason for all his foolish prattle and subterfuge subterfuge about publication publication of Rosicrucian books. But in makin g his argument to get himself out of a bad hole and in attempting to jus ti fy an un ju st if ia bl e po si ti on he i na dv er te nt ly b et ra ys th e hopeless weakness of his own position and recognizes and admits the strength and soundness of our position. As early as in 1917 he he formed the habit of talking and explaining himself out of court. It is the outworking of the law that murder will out; that the con sciousness .of wrong cannot be suppressed; that wrong will right itsel itselff and that eve ry crime carries its own punishment. It is the law of compensation so profoundly interpreted by Ralph Waldo Emerson. It will be noted that Mr. Lewis concedes the exclusive right to the use of Rosicrucian names and titles to establish p r io r use in America even though he possessed authority to use such names granted by charter issued by the highest Rosicrucian authority abroad, which authority he has never received and does not now posses s by ch a rt e r or ot he rw is e fr o m an y au th en ti c Ro si cr uc ia n body. It is not our purpose here to discuss at any length Mr. Lewis' Rosicrucian authority nor to quote his many varied and contradic tory claims claims and-st ateme nts relat ing to it. Suffic Sufficien ientt to say that, in his article of October, 1917, from which we have made extensive quotations, he disclaims any foreign authority, as he has on other occasio occasions. ns. There is not the slightest doubt that Mr. Lewis was fully ac quainted with all the activities of the Randolph Foundation of the authentic Order of the Rose Cross and its continuous use of all Rosicrucian appellations up to the time and since he organized the A. M. O. R. R. C. C. its establishment down to this day, but Dr. Randolph’s Rosicrucian activities were known and publicly recognized in 1872, when all the cohorts of hades were banded together to take from P. B. Ran dolph all that for which he had labored and sacrificed during many years, when he was pe rs ec ut ed as well as prosecuted because of his then advanced ideas, ideas, at which which trial he was acquitted. C. has used the name or term " T c m p h o f t h e Rosy C r o s s continuously in North America and in the State of Pennsyl vania'since 1909,” and that the Royal Fraternity Association, meaning the Randolph Foundation, “has not used this name in America or in the State of Pennsylvania until the last five years." Search where we will, we cannot find the use of T e m p l e o f n i l R o s y C r o s s in any of the A . M . O . R . C . literature, but we do find it stated time and again that the Lewis organizatio n is known only as T h e A n c i e n t a n d M y s t i c a l O r d e r R o s a e C r u c i s . If it has been used, used, which is is extremely doubtful , it is very recently. In 1871 Randolph selected Freeman B. Dowd, a high initiate, trained and initiated into the Sublime Lhird under his immediate supervision, to be his successor. successor. Several of the Council of Seven residing in Philadelphia, the first center of the activities of the Supreme Council in America, urged Dowd to establish establish a Gr and L odg e in that city. Accordingly, in the year 1878, he began the formation of a Grand Lodge in Philadel ph ia , wi th hi ms el f as G r a n d M a s t e r , u nd er t he na me a n d ti tl e o f “The T emple of the Rosy Cross,” and completed his task in 1882. 1882. While there he completed his first book, which he published under the title of The Temple of the Rosy Cross. While in Californi a, he rewrote and greatly enlarged his book, The Temple of the Rosy Cross , and the Rosy Cross Publishing Company, of San Francisco, California, was established for the purpose of publishing it and othe r Rosicrucian literat ure. Do wd ’s activities in San Francisco arc attested by the copyright certificate for the revised second edi tion issued to him in 1888. Both of these editions of The Temple of the Rosy Cross contain the official symbol of this phase or degree of the Grand Fraternity — a sy mbo l, by t he wa y, whi ch wa s th e es cu tc he on o f “ H o u s e of Dowd.” In E v o l u ti ti o n o f I m m o r t a l i t y , written by Dowd in 1894 and pub lished under the pen name of “Rosicrucia;,” which he dedicated to the Queen of the Rosy Cross, in the Appendix, Chapter XVIII, he gives a comprehensive review of just what this association of men is, of the purposes and teachings of the Fraternity and the various appellations under which the Fraternity, Temple or Order has been known during the various stages and ages of its history. During Dowd’s tenure of office as Supreme Grand Master of the Fraternity, the Rosicrucian title or appellation, T h e T e m p l e o f the Rosy Cross, was so generally used that it became prominent and was well well and generally known. Of this there can be be no mistake. mistake. It is is an established established fact beyond the pale of controver sy. Howev er, it is an appellation which has been used by the Randolph Founda tion since 1856-58 to the present time. To show the continuity of the Randolph Foundation, we next consider Paul Ty ne r and his activity in its behalf. In 1897 Paul Tyner was stationed in Denver, Colorado, and in connection with his work there he edited and published, through the Temple Pub lishing Company, the monthly magazine, T h e T e m p l e , devoted to higher human culture, spiritual science and the philosophy of the Rosy Cross. In this magazine, July issue, 1897, beginning with page 56, a complete manifesto of the Temple, Order, Fraternity and Brother hood, giving an outline of its work, aims, philosophy and culture, was published. Thi s was autho rita tive because it was pre par ed by by Freeman B. Dowd, under his initiate n a m e : Rosicrucia. The writer’s connection with the Fraternity dates from the year 1896 as a neophyte. Our. Our. public work star ted with t he publication of T h e P h i l o s o p h y o f F i r e as an exposition of the philosophy of the Frate rnity , first first published and copyrigh ted 1907. Thi s was followed by the publication of The Rosicrucians, Their Teachings, first published in 1903, and The Fraternity of the Rosicrucians, first first copyrigh ted and published in in 1906. In the two works last above mentioned, containing a republication of all the prior public manifestoes of the Grand Masters of the Randolph Foundation, is to be found evidence in abundance which overwhelmingly and completely establishes the p ri or use by the Randolph Foundation in America of the authentic Order of all Rosicrucian terms, titles, names and appellations, and at the same time completely and over whelmingly proves cver.y claim under oath or otherwise made by Mr. Lewis concerning the right to use any Rosicrucian names or appellations to be absolutely false and without the slightest jus tification.

Swinburne Clymer became a full member of the H e r m e t i c B r o t h e r h o o d , he prepared and published a book on the inner teachings of the old Mystics, Hermetics and Rosicrucians. HISTORY OF THE CASE The Fraternity of the Rosicrucians (Order of the Rose Cross an unincorporated association, society or order, its activities bein fraternal, philosophical, metaphysical and religious, non-sectariai has presented lor registration with the Secretary of the Commoi
The Order of the Rose Cross or Rosicrucian Order was started in America in the year 1856-58 by Dr. P. B. Randolph, of Boston, Mass., who subsequently thereto, in 1871, copyrighted and pub lished his book R a v a l e t t e , dealing with “The Rosicrucians.” In Pennsylvania the Fraternity, Order and Brotherhood of the ^Rose Cross, or Rosy Cross, or Rosicrucians, has existed under the pre se nt ju ri sd ic ti on si nce a bo ut th e ye a r 187 8. The volume The Rosicrucians, Their Teachings was published by t he pr e se nt G r a n d M a s t e r o f t he O r d e r in t he ye a r 190 3. The Fraternity of the Rosicrucians was copyrighted and pub lished in the year 1906. In 1908 was published a monthly magazine entitled “ T h e Ro Ro s ii- crucian Brotherhood, The Initiates," and in 1911 a volume en titled " W h o I s a R o s i c r u c ia ia n ? ". On May 12, 1927, the title

From the above references it is pa t en t t h a t th e ap pl ic an t as so ci at io n sin ce th e y e a r 1'871 ha s con tinuously tinuously and uniformly used in its its work the terms Frate rnity of the Rosicrucians, Order of the Rose Cross, Brotherhood and Temple of the Rosy Cross, the Fraternitatis Rosae Crucis, Rosicrucian Brotherhood and Order and similar variations in the designation of its order, association or fraternity, which it found convenient to use in its activities.
Applicant lately found it advisable to register its various names or appellations in Pennsylvania, owing to the fact that others were attempting to appropriate the same or similar names in their ac tivities to the det rim ent of applicant. Accordingly, applications were presented to the Secretary of the Commonwealth for regis tration of the three names above referred to.

A R G U M E N T The application for the three organization names or titles is made made under Section Section 1 of the Act of M ay 16, 16, 1923, above cited, the organizations not being incorporated. The act was passed for the purpose of affording any associa tion, society, order, foundation, federation or organization or any Pennsylvania corporation of the first class theretofore chartered, a means of registering and protec ting the name, title or designation under which it was doing business or operating. Section Section 1 of the act act provided that the name should first be reg- a fter which the same should be protected as provided in i s t e r e d after Secti Section on 2 by the following word s: “ nor shall any re gistration under the provisions of this act be made f or any association . . . having a name, title or designation similar to or imitatin g or so nearly re sembling as to be calculated to deceive, or using any name, title or designation, S O r e g i s t e r e d , without the consent of the regis trant ;” &c. Section 4 of the act provides that the Secretary of the Common wealth shall keep an indexed record of the registrations and can cellations/ Section Section 5 (which is now superseded by Section Section 202 an d Section 2 04 04 o f t h e N o n -P -P r o f i t C o r p o r a t i o n L a w ) p r o v i d e d f o r t h e a p p r o pr ia ti on of ti tl e by a p ro p os e d fi rs t- cl ass c o rp o ra t io n an d r eq ui r ed a certificate that the name adopted has been filed and recorded in his office and that a search of his records fails to disclose anv conflict bet wee n th e na me o f th e p r op o s ed c or p or at io n an d an y o t h e r na me ,

From the wording of the act, therefore, it is contended by the applicants that there is no authority in the Secretary of the Com monwealth to entertain protests generally to the registration of a title by any association, society or organization, but that he might po ss ib ly en te rt ai n p ro t es t s only as to such as have already regisi lered with him under the provisions of the act; that unless he finds that the name or title of the applicant is “similar to or imitating or so near ly res embling as to be calculated to deceive,, or using a name, title or designation" already registered and appearing upon his record of registrations , under the provisions of the above act, he is without authority to entertain any objection from a non registrant and he should accordingly register the title submitted. It is respectfully submitted that there is no authority in the above or any other Act of Assembly for the Secretary of the Common wealth, aside from his records, to pass generally upon the rights of contending parties to the use of a particular name or title, but that such questions must be left entirely to the determination of the courts. Applicants respectfully call the attention of the Department to the fact that the protest filed does not object to the identical names sought to be registered, there being a decided variation between the names listed in the protest and those applied for. From a search of the official records it is contended that— 1. Protestant has not heretobefore registered its name, title or designation under the above act. 2. I hat there has been no no approp riat ion by registra tion of the the identical names, titles or designations applied for by applicants. 3. I hat a search of the records will will not show registrat ion of any name, title or designation, imitative or so nearly resembling as to be ca lc ul at ed to de ce iv e, o r si mi la r to th e t h re e ti tl es fo r which registration is applied. 4. Th at, consequently, the Secretary of the Commonwea lth should, as provided by the above act, register the three names, titles or designations as here pre sented b> b>> the applicants. Even though the Secretary of the Commonwealth may not agree with the above argument that there is no discretion in the matter, it is respectfully submitted that under the practice existing for many years in the Department, governing the granting of corpo rate and other titles, the above names are not objectionable, and that under such practice there is no similarity between the titles

In addition it is contended that the titles‘applied for are prior in use in the appl icants as is above set fort h in "the "the H ist ory of the Applicant heretofore recited, . . . referring specifically to the work “The Rosicrucians, Their Teachings," published by Dr. R. Swinbu Swinburne rne Clymer, Clymer, Grand Ma ste r of the Order, in the year 1003; to the U. S. copyright of the title of print or pictorial illustration of “Knights of the Rose and Cross, Exhibit B, issued in the year 1913; to his copyright of the work “The Fraternity of the Rosi crucians," issued in September, 1906, all of which appear and are referred to in the History of the Applicant on page 2 of this brief (Exhibits B and C ). Applicants also call specially to the attention of the Secretary that that portion of Section Section 1 of the above Act, Act, which which provides that any “association, society, order, foundation, federation or any cor- por at ion o f the firs t class he re to fo re ch ar te re d un de r the laws oj the Commonwealth may register with the Secretary of the Com monwealth the name, style or designation under which he, they or it are doing business business or operati ng. . . ." It is respectfully submitted that the protestant, the “Supreme Grand Lodge of the Ancient and Mystical Order Rosae Crucis, the Rosicrucian Order,” appears to be a corporation of the State o) California, power of attorney and statement having been filed by it as a foreign corporation under the Act of June 8, 1911, P. I.. 710, the same being filed in the office of the Secretary of the Common wealth wealth on the the 24th day of September, 1934. 1934.
