ISSUE/ 3as the #ourt #orre#t in denying the opposition of the heirs of .nri/ue4 HELD/ 5o, the upre"e Court a7r"ed the de#ision of the lo%er #ourt* !he appellants assert in their argu"ent that 8personal noti#e %as a+solutely ne#essary in order to ustify the #ourt +elo% in rendering a de#ree in faor of the plainti and appellee, in the :rst instan#e8* !he #ourt ruled that personal noti#e is not a+solutely a prere/uisite to the alidity of title under the !orrens syste"* !he re#ord also sho%s that the #ler$ of the Land Court "ade a #erti:#ate sho%ing that that noti#e had +een issued and pu+lished in a##ordan#e %ith the la%* e#tion ;2 proides, in part, that said 8#erti:#ate of the #ler$ that he had sered the noti#e as dire#ted +y the #ourt, +y pu+lishing or "ailing, shall +e :led in the #ase +efore the return day, and shall +e #on#lusie proof of su#h seri#e*8 e#tion ;< of said '#t 5o* =96 also proides that> 8.ery de#ree of registration registration shall +ind the land and /uite the title thereto, su+e#t only to the ex#eptions stated in the follo%ing se#tion* t shall +e #on#lusie upon and against all persons, in#luding the nsular ?oern"ent, and all the +ran#hes thereof, %hether "entioned +y na"e in the appli#ation, noti#e or #itations, or in#luded in the general des#ription @!o all %ho" it "ay #on#ern*@8 !he pri"ary purpose of !orrens orrens Land La% is the registration registration of the title %hi#h the appli#ant or petitioner has and to reliee his land of un$no%n liens or #lai"s, ust or unust, against it* !he re/uire"ent that personal noti#e shall +e a prere/uisite to the alidity of registration %ould a+solutely prohi+it the fore#losure of un$no%n #lai"s, for the reason that personal noti#e #ould neer +e gien to 8un$no%n #lai"ants*8 !he great di7#ulty in land titles arises fro" the existen#e of possi+le un$no%n #lai"ants*
