JUDICIAL AFFIDAVIT OF JOHN A. JUAN
I, John A. Juan of legal age, married, and living at Baculud Iguig,, petitioner in this case, state under oath as follows: PRELIMINARY STATEMENT The person examining me is Atty. Kimberley Matammu with address at Carig Sur Tuguegarao City. The examination is being held at the same address. I am answering her questions fully conscious that I do so under oath and may face criminal liability for false testimony and perjury. This affidavit/testimony of petitioner John Juan is being offered to prove that the respondent Jaime Tuo is indebted to plaintiff the sum of Three Hundred Fifty Thousand Pesos (php 350,000.00), Philippine Currency. The petitioner’s testimony is also offered to prove that defendant Jaime Tuo unlawfully refused to pay the lawful demand of the plaintiff. 1. Q. Please state your name and other personal circumstances for the record. A. I am John Juan, 45 years old, farmer and residing in Baculud Iguig, Cagayan 2.
Q. Are you the same John Juan, the petitioner in this case? A. Yes ma’am.

Q. Do you know a certain Jaime Tuo? A: Yes ma’am. He borrowed money from me in the sum of Php 350,000.00
4. Q: When did Jaime borrow money from you? A: August 07, 2014 5. Q: Do you have any proof that indeed Jaime borrowed money from you on the said date? A: Yes ma’am. He executed a document in an Ilocano dialect in the presence of Patrick One, Juan Two, as Barangay Kagawad, Kerry Bells as Barangay Secretary and Kemer Lou as Barangay Captain where he had acknowledged his indebtedness and where he had promised to pay the me the sum of php350,0000 on October 07 2014,(Exhibit “A”) 6. Q: Did Jaime pay his indebtedness on October 07, 2014? A: He failed to pay the said obligation on due date, 7. Q: How did you settle this matter? A: I approached Atty. Paul Let to formally send letter of demand payment of their indebtedness. (Exhibit“B”) 8. Q: Did he answer your demand? A: He failed to comply with such demand. 9. Q: What did you do next? A: I tried to settle the matter with him to the level of the proper lupon of Baculud Iguig, but he refused to settle it. 10. Q: Do you have any proof that Jaime indeed refused to settle his indebtedness? A: Yes ma’am .Certificate to file Action (Exhibit “C”)
