The method of writing followed in the course of this research project is primarily analytical. The researcher has followed #niform method of citation throughout the course of this research project.
!t is well nown that not all legislation is made b y Parliament itself. Traditionally2 legislation is divided between primary legislation enacted by Parliament2 and delegated legislation promulgated by the e"ecutive. 4hile primary legislation sets out matters of policy and substance2 the implementation and detail is delegated to the e"ecutive. !t is the detail and implementation of the primary legislation that impacts on daily lives. The cost of a driver5s licence2 the daily limit for taing of shellfish2 and what substances can safely be included in your breafast cereal are all the subject of delegated legislation rather than Acts of Parliament.
*elegated legislation %also referred to as secondary legislation or subordinate legislation& is law made by an e"ecutive authority under powers given to them by primary legislation in order to implement and administer the re6uirements of that primary legislation. !t is law made b y a person or body other than the legislature but with the legislature7s authority. *elegated legislation means permitting bodies beneath parliament to pass their own legislation. *elegated legislation is not to be confused with the e"ecutive legislation. The former stands for the laws made by the authorities other than the legislature to whom the legislature delegates its legislative power.The latter stands for the laws made by the President and the governer respectively under article '89 and 8'9 of the constitution.These laws are in the form of ordinances which have the force of law.such ordinances are issued by the respective e"ecutive heads and they are re6uired to be ratiffied by the respective legislature2namely2the parliament and the state legislature 2as the case maybe2after they meet .such an ordinance ceases to have effect if it is not rattified within si" wees after the assembly of legislature .the source of delgated legislation is always an act of legislature whereas the source of the e"ecutive legislation is a constitutional provision.
